John Thorson writes: US v. Braren (9th Cir. July 21, 2003)--The United States and the Klamath Tribes had successfully sought to reopen the Adair litigation before the Oregon federal district court to seek clarification of whether the tribal treaty right extended to water for the gathering of plants. Relying on the Colorado River absention doctrine, the Ninth Circuit reverses and vacates the trial court decision and orders that further federal court proceedings be stayed pending completion of Oregon's adjudication.
Alsea Case
Oregon District Court Judge Michael R. Hogan granted a motion for summary judgment agreeing with plaintiffs' contention that the National Marine Fisheries Service acted arbitrarily in exempting hatchery coho salmon from its decision to list the species as "threatened" under the requirements of the Endangered Species Act.
